On 21^st November 2019 in the Court of Appeal - Sofia will be a public distribution of etc. № 1718/2019 according to the inventory of the Sofia City Court (SCC). In connection with the Order of the court №5200 / 03.10.2019 by tender. case № 1718/2019 on the inventory of the Sofia City Court, TO, VI-7 s-v, which allowed collateral for the claims brought by #”BISOFT” LTD. against the NATIONAL LEGAL AID BUREAU, by IMPOSING TEMPORARY MEASURES: PROHIBITION for the use of the software product for reporting the legal aid electronically, which is currently being worked on by NLAB, provided that the plaintiff submits on the basis of Article 391, paragraph 1, item 2 of the Civil Procedure Code CASH # GUARANTEE in amount of BGN 36,000. The determined cash guarantee was paid by “BISOFT” LTD. on 11.10.2019, we inform you about the following:

Software system "developed" in implementation of the Agreement dated 20.07.2017, concluded between the National Legal Aid Bureau / NLAB / and the Managing Authority of the Operational Program "Good Governance" / OPGD / for the implementation of the project "Strategic Reforms in the National Bureau" for Legal Aid "under Priority Axis № 3" Transparent and efficient judicial system"

are subject to two court proceedings under the Copyright and Related Rights Act, as follows:

    With regard to Software system / software product dWareOS with defendant DEWARE LTD. - commercial case № 1719/2019 according to the inventory of the Sofia City Court, Commercial Division, VI-9 panel;

    Regarding the Software System, "developed" in implementation of the Contract of 20.07.2017, concluded between the National Legal Aid Bureau / NLAB / and the Managing Authority of the Operational Program "Good Governance" with the defendant National Legal Aid Bureau - Commercial Case № 1718/2019 on the inventory of the Sofia City Court, Commercial Division, VI-7 panel.

That is why “BISOFT” LTD. calls for no actions to be taken for integration of the above-mentioned software products until the end of the court proceedings with court decisions that have entered into legal force.

On 1^st November 2018, “BISOFT” LTD. and the SUPREME COURT OF CASSATION concluded an AGREEMENT FOR NON-EXCLUSIVE AND TERM RIGHT TO USE THE SOFTWARE SYSTEM "SERVICE" FOR SERVICE PROTECTION.

The integration of the module in the SUPREME COURT OF CASSATION is a guarantee for the legality and functionality of the legal aid mechanism of the software system developed by “BISOFT”.

SOFTWARE SYSTEM "OFFICIAL PROTECTION" module "Instances" provides the transfer / exchange of information between the integrated bar councils and the Supreme Court of Cassation, thus supporting the activities of the NATIONAL LEGAL AID BUREAU in accordance with the PPA.

“BISOFT” LTD. has created the unique software systems “LEGAL AID” and “OFFICIAL PROTECTIONS”, according to the powers of the Bar Councils and the National Legal Aid Bureau of the Republic of Bulgaria, defined in the Law on Legal Aid, and according to the introduced terms and conditions in the said law on the provision of legal aid / procedural, internal /.

The copyright of a software / information / system for reporting the legal aid electronically under the PPA is with the author of “BISOFT” LTD., and in this connection, there is a dispute under the Law on Legal Aid before the Sofia Court, Civil Registry, 1-12 pp. gr.d.№11854 / 2015 scheduled for 10^th May 2018 with defendants Ministry of Justice and NLAB with the participation of the third person-assistant "DUEAR" Ltd.

At the beginning of 2010, with a contract, “BISOFT” LTD. donated for the use of NLAB its own software system for reporting legal aid electronically. From then until the end of 2014, this software system was upgraded over the years in order to improve it in the service of its users - NLAB and lawyers in a country providing free legal aid under the PPA. At the end of 2014, after repeated attempts to obtain a DECLARATION of CONFIDENTIALITY from the Chairman of the NLAB Elena Cherneva-Markova, in order to protect the software system itself and the refusal of NLAB to sign such a declaration led to the introduction of general conditions that only protect the authorship of the system and in no way change or introduce new clauses in the donation contract. These general conditions had to be confirmed by each employee of NLAB working with the software system by pressing the "ACCEPT" key and to start using the software system.

Instead, on the verbal orders of President Elena Cherneva-Markova, employees stopped using the system!

A single employee Iva Ivanova has confirmed the general conditions, which in practice gives her the right to use the software system / according to the witness Venkov, an employee of "Paraflow Communications" /.

An interesting question is why a state body that disposes of budget funds of the Ministry of Justice refuses to use a DAREN FREE / FREE / software product and instead on its own initiative enters into a contract with DUER Ltd. for the use of a paid software product for reporting legal aid electronically, which product is the only one and the authorship of it belongs to “BISOFT” LTD.? The lawyers registered in the register of NLAB for legal aid I hereby inform you that the Sofia Court has accepted an expertise according to which NLAB works with software system "LEGAL AID", which is copied from the system of “BISOFT” LTD. - "Legal Aid", as a result of which NLAB will probably have to switch to manual processing of the received reports by lawyers registered in the National Register for Legal Aid in a short time. This in turn will lead to a delay in the processing of the Reports and the payments on them. Unpleasant for you, the lawyers, but let's try to think who allowed this?

Sadly, very sadly..., LAWYERS, please take a stand! This is important for the lawyers in the country ..., another hoax with ATTORNEY, registered under the Law on Lawyers ..., and why did you allow it ... Don't you have bodies to think about you, instead of being a servant of the Chairman of the NLAB - lawyer Cherneva-Markova.

I think it should work for you, the lawyers - their funding from the Ministry of Justice is not a reason to hinder your work, is it?

NOTICE BY BISOFT LTD. REGARDING THE STATEMENT MADE BY THE NATIONAL LEGAL AID BUREAU (NLAB) OF 24.11.2014, PUBLISHED ON THE NLAB WEBSITE AT 12:49 P.M. ON 24.11.2014.

Honorable public defenders, 

BiSoft Ltd. hereby expresses its full disagreement with the NLAB statement published on the NLAB website at 12:49 P.M. on 24.11.2014.

BiSoft Ltd. contests the NLAB claims expressed in that statement as false.

BiSoft Ltd. is the developer, author and owner of the Legal Aid Software System (LASS), and the person providing the system software support, and in exercising its rights to protect LASS from illegal and factual actions and omissions it presented the General Terms and Conditions of LASS (GTC of LASS) on 17.10.2014.

The GTC of LASS are integrated and implemented in the system itself. They are technological and functional enhancement of the system, which aim at prevention, protection and security of the LASS, NLAB (GRATUITOUS USER), and BISOFT Ltd. (OWNER-DEVELOPER-AUTHOR). They are consistent with the law and the contract, and with the imperative and mandatory provisions of the national and international law, and do not constitute an amendment of the arrangements between NLAB and BiSoft Ltd., nor are they a proposal for the amendment of these agreements. They represent integrity and implementation of the basic and compiled source code of the LASS and are developed by the owner-author-developer.

Therefore, the GTC of LASS do not constitute new unfair provisions, nor are they ultimate, limiting, modifying, unacceptable or contrary to any provisions and practices, but they are deliberately and seemingly qualified as such by the NLAB and its chairman, Mrs. Cherneva-Markova.

THE GTC OF LASS ARE UNACCEPTABLE ONLY FOR THOSE WHO WANT TO ADMINISTER LEGALLY AND FACTUALLY THE PROGRAM FILES OF THE LASS SOURCE CODE UNLAWFULLY AND TO VIOLATE THE RIGHTS OF BISOFT LTD, AND FOR THOSE WHO CONDUCT NO REAL LEGAL PRACTICE OR ARE DISHONEST AND PURSUE HIDDEN AGENDAS.

The NLAB and its employees deny confirming the GTC of LASS ON PURPOSE, under order of the chairman of the NLAB, Mrs. Cherneva-Markova, and refuse to work with the LASS despite their own internal controversial Resolution No 132/10.28.2014 issued by the NLAB.

THE NLAB GAVE A FALSE IMPRESSION OF DIFFICULTIES WHILE MRS. CHERNEVA-MARKOVA TRIED TO CONVINCE THE SUPREME BAR COUNCIL TO DEVELOP ITS OWN SOFTWARE SYSTEM ON 17.10.2014. MEANWHILE THE NLAB ALLOWED A THIRD PARTY ACCESS TO LASS IN ORDER TO COPY IT AND USE IT ILLEGALLY.

In order to resolve the situation, BiSoft Ltd. notified the relevant competent authorities and requested their assistance.
